Notice on the processing of personal data under the Swiss Federal Act on Data Protection (FADP).

2. Data collected

We collect personal data exclusively through the contact form on our website. The data collected may include:

  • First and last name
  • Email address
  • Phone number
  • Content of your message
  • Service of interest selected

Providing these data is voluntary. However, failure to provide the data marked as required (name, email) may make it impossible to fulfil your request.

3. Purposes of processing

The personal data collected are processed for the following purposes:

  • Responding to your contact and quote requests
  • Providing information on our gardening services
  • Arranging site visits and consultations
  • Managing any contractual relationship that may be established

4. Legal basis

The processing of your personal data is based on the following legal grounds under the Swiss Federal Act on Data Protection (FADP, SR 235.1), in force since 1 September 2023:

  • Consent (art. 31 para. 1 FADP): by submitting the contact form, you consent to the processing of the data provided for the purposes described above.
  • Overriding interest (art. 31 para. 2 lit. a FADP): processing may also be based on an overriding interest of the controller, for example for the performance of pre-contractual measures requested by the data subject.

5. Google Fonts

This site uses Google Fonts, a service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA), to display typefaces.

When you visit a page on our site, your browser downloads the required fonts directly from Google's servers. In this process, your IP address is transmitted to Google LLC in the United States. Google may use these data in accordance with its own privacy policy.

6. Google Maps

On the contact page of our site we use Google Maps, a mapping service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA).

When you visit the contact page, your browser connects to Google's servers to load the map. In this process, your IP address and other technical data (such as browser type and operating system) are transmitted to Google LLC in the United States.

7. International data transfers

As indicated in points 5 and 6, the use of Google Fonts and Google Maps involves the transfer of data (IP address) to Google LLC in the United States of America.

The Swiss Federal Council has set out, in Annex 1 of the Data Protection Ordinance (DPO), the list of countries that guarantee adequate data protection. Transfers to the USA may take place on the basis of appropriate safeguards, in particular standard contractual clauses approved by the Federal Data Protection and Information Commissioner (FDPIC), as well as the EU-US Data Privacy Framework (DPF), to which Google LLC adheres.

8. Data retention

Personal data collected through the contact form are retained for the time necessary to fulfil your request and, subsequently, for a maximum period of 2 years from the closure of the file, except where different legal retention obligations apply.

If a contractual relationship is established, the data are retained for the duration of the relationship and subsequently for 10 years in compliance with the retention obligations under Swiss law (Code of Obligations, art. 958f CO).

9. Rights of the data subject

Under articles 25-29 of the FADP, you have the right to:

  • Right of access (art. 25 FADP): obtain information on the personal data concerning you that are being processed.
  • Right of rectification: request correction of inaccurate personal data.
  • Right of erasure: request deletion of your personal data, within the limits provided by law.
  • Right to data portability (art. 28 FADP): request the delivery of your personal data in a commonly used electronic format or their transfer to another data controller.

10. Data security

We adopt appropriate technical and organisational measures to protect your personal data against accidental loss, unauthorised access, modification and unlawful disclosure, in compliance with art. 8 FADP.

11. Supervisory authority

The Swiss authority responsible for data protection is the Federal Data Protection and Information Commissioner (FDPIC).
